On 1 September 2016, a hearing was held in the Federal Court of Australia before Justice Bromwich regarding Volkswagen and Audi’s claim of legal professional privilege over certain documentation.
Judgment was handed down on 22 November 2016. Justice Bromwich accepted VW’s argument that the advice it had received from its lawyers, and other documents referring to that advice, should not be disclosed because such documents were protected by client legal privilege.
Accordingly, these documents will not be made available to us in these proceedings. However, it remains a matter of public record that the German regulatory body (the KBA) has found that the VW vehicles were fitted with illegal ‘defeat’ devices even though in the present proceedings this continues to be denied.
We are next before the Federal Court of Australia on 14 December 2016 at which point a further timetable will be set.
